A mistrial is defined as an invalid trial, caused by fundamental error. When a mistrial is declared, the trial must start again from the selection of the Jury. This very thing happened to John “Junior” Gotti after 11 days of the trial. This was no the first time it happened, there have been three that also were ended with a hung jury. It is said that John Gotti, son of a past ‘mob boss’, has acted in many violent acts including the murders of three people. In Gotti’s defense, lawyers say he has been out of the mob since 1999 and is not to blame for any of these accusations that are being put against him.
“…problem that we couldn’t come to a decision on. Six felt he did not. Five feel he did withdraw. One was undecided,” said one juror, tells CNN. This is the fifth trial that the jurors could not come to a clear verdict. John ‘Junior’ Gotti is still not proven guilty or innocent. Many people just assume he is guilty because of his father’s past but the lawyers are fighting. Some jurors are torn, some think he is completely guilty or is innocent, others just feel it is a waste of time and money and the whole thing should be dropped. They still do not know what is to come. Gotti is out on two million dollar bail. Many are disappointed in what it has come to.
